Last Friday, a San Diego took the motion for class certification on the case of Ken Hinther et al. vs Electronic Arts and Origin Systems "under submission." This delayed her deciding on whether this complaint was going to be considered a class action suit or not.
Today, Judge McConnell rendered her verdict in the motion: "Plaintiff's motion for class certification is denied," she said in today's ruling.
Attorney for the gamers George Schultz said, "By no means is this a dismissal of the case... it's no comment on whether it's a good case."
Schultz added, "We're going to go forward with the suit...We see a real obligation to go forward and see what we can do to make this right."
Schultz told GameSpot News he is considering his options. "We are either going to appeal the judge's decision or find some way to reword the complaint ."
